Ideal Jobs- Terms and Conditions

 

This website and the services and product provided there in exclusively available to users seeking employment, employees and employers, and also for  training and education purposes and are subject to the terms and conditions which are stipulated hereunder . By accessing this website and any pages thereof you agree to be bound by the terms and conditions stated therein.

Upon acceptance of these terms and conditions, they are binding on the user. The company may revise these terms and conditions from time to time and the user of the website (idealjobs.lk) is advised to visit this page periodically to review the terms and conditions. The services provided by the company to the user will be terminated upon your notice to the company and also in the event the changes are unacceptable the services are terminated forthwith.

 

The use of information- Jobseekers

 

Jobseekers agree that they will only use the company’s website for the purpose of seeking employment. Jobseekers may send their resume to the company’s website then the company (idealjobs.lk) collects personal information such as your name, email, address and relevant details for employment purposes and registers them with idealjobs.lk. Jobseekers resume will remain active on the employees website for a considerable period of time unless the jobseeker chooses to delete it.  Jobseekers acknowledge and agree to the company that the use of the company’s website for the purpose of employment is subject to payment of a fee by the employer and agree that he/she has no claims to any such fee received by the company. The company will not release the jobseekers personal data to any prospective employer without his/her authority.

The jobseekers agree that the company will not be responsible for or held liable under any circumstances if any employer in Sri Lanka or elsewhere use the jobseekers personal data given to employers or other users are given entirely at their own risk.

 

The use of information- Employers

 

Upon making the service fee to the company or on acceptance of any free trial promotion, the employer will be entitles to use the company’s website to advertise vacancies for jobs and or create their own webpage on the company’s website for a predetermined service. The employers will be entitled to access the company’s database but agree that all the information obtained will only be used for purpose of obtaining potential employees, jobseekers. The employers will be solely responsible for the contents and material contained in their advertisements and webpages. The company reserves the right to edit the dates of duration of the advertisement or webpage as it thinks suitable. The company reserves the right to change the service fee or introduce new charges or fee with accordance with the prevailing market conditions. In the event any employer should fail to pay the service charge or any other fees due the company, the company reserves the right to suspend or terminate the employers account and advertisement without prejudice to all the rights and remedies available to the company.

This agreement is governed by the laws of Sri Lanka and the advertisers hereby submit to the jurisdiction of the courts of Sri Lanka.

 

1. Advertiser or the party contracting for the advertisement of an employment shall refer to the registered company i.e.    idealjobs.lk or its database.

 

2. Service: shall include any service provided by the company including but not limited to

i. The provision online recruitment advertising.

ii.The provision of online resume search access.

iii. Matching of job specification with candidate profile and advertising them of the position availability through job alert email.

 

3. The company shall: comply with all applicable laws and regulations with respect to the provision of services.

i. Make every effort to publish advertisements on the website within the reasonable business time frame. Idealjobs.lk is not liable for any loss or damage incurred by the advertiser as a result of any failure or delay in publishing an advertisement.

 ii. Make every effort to avoid errors in advertisements. However, idealjobs.lk accepts no responsibility or liability for any errors as soon as they are placed. Any errors maybe edited within one business day upon notice by the advertiser.

 iii. Undertakes its best efforts to make the service available for access throughout the day. Idealjobs.lk shall not be held liable for any interruption of service although it may undertake remedial measures to republish an advertisement when appropriate.

 iv. Undertake its best efforts to retain the job advertising of the advertiser and resume of jobseekers.

 

4. The advertiser shall at all times; ensure they comply with all applicable laws and regulations.

i. Comply with all notices, instruction and communication given or sent by idealjobs.lk with regard to the use of the service

ii. Shall not disclose confidential information obtained through the use of the services to any third party.

iii. Shall not use the information obtained as a result of the use of the service for any purpose whatsoever other than for the purpose of employment.

iv. Warrant that information obtained as a result of the use of the services will not be used for solicitation to the applicant for purpose of product /services, compilation of database information for any unauthorized use or sale disclosure to any third party, contract with the user for any purpose other than potential employment.

 v. Shall not use the service to redirect user traffic and oblique or user resume to the advertisers own website or any other party website.

 vi. Provide and maintain accurate compete and current data required to register the advertiser with idealjobs.lk.

 vii. Not infringe on the intellectual property rights of any person or company including idealjobs.lk or download and copy information obtained through use of the service with the intention to do so.

 viii. Not allow or transfer to any third party their right to access the service under their account without prior written approval of idealjobs.lk

 ix. Be solely responsible for maintaining the security of any user ID’s and or passwords provided to them to access the service.

 x. Not use the system for any unlawful purpose including, but not limited to the introduction or transmission of any data or program containing computer virus, computer worm, Trojan horse or other harmful or malicious codes.

 xi. Not send email, messages, information or communication of any type, nature through the system that may contain malicious, immoral, derogated or otherwise illegal materials.

 xii. Agree to defend, indemnify and hold harmless idealjobs.lk from and against any claims, actions or demand alleging or resulting from your use of the service or your breach of the terms of the use.

 

5. Payment of Fees.

  i. All amounts payable to idealjobs.lk must be paid within the specified payment terms from the date of the invoice. Idealjobs.lk may charge interest on any late payment.

  ii. Prices for services may vary at any time with notice. Advertisers shall not be entitled for any rebate or discount on previous agreed contracts/Sales orders as a result of changes to the pricing.

  iii. Advertiser shall be liable for full payment of service fees from the commencement of the contract. Payment must be made not withstanding any errors or any omissions in the advertisement.

  iv. All process quoted are exclusive of any applicable taxes unless specifically noted otherwise.

 

6. Suspension

  i. Without prejudice to any other rights, idealjobs.lk reserves the right to suspend access to any and all aspects of its services without refund in the event of non-compliance by the advertiser with these terms of use.

 

7. Disclaimers.

  i. Idealjobs.lk shall not be liable for any loss of information howsoever caused whether as a result of any interruption, suspension or termination of the services or for the contents, accuracy or quality of information available or transmitted through the services.

  ii. Idealjobs.lk makes no representations and warranties of any kind, whether expressed or implied for the services and in relation to the accuracy or quality of any information transmitted or obtained through the service. To the fullest extent permitted by law, idealjobs.lk disclaims any representation or warranty, whether expressed or implied, as to the title, fitness for particular purpose, merchantability, accuracy or standard of quality of the services and or and database central, no warranty whatsoever is given that the service will be uninterrupted or error free or relation to the database content obtained and or services otherwise specifically mentioned in this agreement.

   iii. Idealjobs.lk shall not be liable for any loss or damages sustained by reason of any disclosure of any information concerning the advertisers account and particular not for any error, commission or inaccuracy with respect of any information so disclosed nor does it endorse any opinion expressed by any other advertiser.

   iv.  Idealjobs.lk does not warrant that its operation, process or any of its websites will be free of any operational errors know that it will be free of any computer virus, computer worm, Trojan horse or other harmful or malicious contents.

    v. The advertiser acknowledges that it is not idealjobs.lk’s policy to exercise editorial control over and to edit or amend any data or any contents of any emails or posting or any information that may be inserted or made available or transmitted to from a third party in or through the service.

 

8. Aggregate Liability

    i. In any circumstances or events where it is held that idealjobs.lk is responsible for any loss of profits, loss, savings, damage, cost or expense of any kind whatsoever and howsoever caused whether rising under contract or, tort including negligence, or otherwise including without limitation loss of or corruption to data loss of production, loss of contracts, loss of operation time, and loss of good will or anticipated savings or other special, direct or indirect punitive consequential or incidental damages arising out of or relating to this agreement any product or service furnished or to be furnished under this agreement for  the use thereof, idealjobs.lk total cumulative liability to the advertiser or to any other person or third party shall be linked to the amount of the price actually paid by the advertiser.

 

9. Use of Data

The advertiser hereby agrees and irrevocably authorizes idealjobs.lk to:-

       i. Use any data information supplied by the Advertiser for idealjobs.lk’s own internal and marketing purposed to its supplying such data and information to any other associated companies or selected third parties to use for such purposes, and to its supplying such data and information  to such third parties as may be necessary for the operation of idealjobs.lk

       ii. Allow all data and information supplied by the Advertiser in using the services to be retained at idealjobs.lk for the use by them notwithstanding the termination or suspension of the service to the advertiser therein.

 

10. Indemnity

     i. The Advertiser shall indemnify and hold idealjobs.lk harmless at all times against all actions, proceedings, costs, claims, demands, liabilities, losses and damages whatsoever including without limitation for the deformation, infringement of intellectual property rights, death bodily injury, property damage or pecuniary losses howsoever arising which idealjobs.lk may sustain, incur, suffer or pay arising out of or in connection with the use of the services by the Advertiser.

 

11. Termination

    i. This agreement and any other agreement of a similar nature maybe terminated at any time by idealjobs.lk by prior written notice to the Advertiser if it is found that the advertiser uses this service in any way or manner that may affect, limit or compromise the interest or business of idealjobs.lk. No refund, compensation or consideration will be awarded to the Advertiser in the occurrence of such event.

 

12. Idealjobs.lk has a principal concern in the responsible use of information that users and Advertisers share and disclose. Idealjobs.lk commitment towards guaranteed confidentiality and privacy at all times is clearly articulated in or privacy policy. Advertisers who use idealjobs.lk must comply to the same standard of protection of all information, as stated in the privacy policy.

 

13. Variation

   i. Idealjobs.lk reserves the right to amend the terms and conditions contained herein ant any time without notice to the advertiser.

   ii. In the event of the Advertiser continued use of service following the amendments constitutes an affirmation and acknowledgement of the amended terms and conditions and also constitute an agreement by the Advertiser to abide and or any other fees similar in nature, directly or indirectly.

   iii. Idealjobs.lk does not accept encourage job advertisements that purportedly promote illegal practices.

   iv. Idealjobs.lk does not accept advertisements that are untrue or otherwise misleading.

 

14. Rights and Discretion

    i. Idealjobs.lk reserves the right and discretion to remove any or all advertisement without any reason, any prior notice and with no refund.

    ii. Idealjobs.lk has the right to make relevant enquiries or of Advertisers to satisfy any issues raised by management or users of idealjobs.lk to ensure that the job advertisements posted on the website are made in good faith in compliance with the above policy.
